The Chick-fil-A® Cowz Bed and Barn Promotion (the “Promotion”) is sponsored by Chick-fil-A, Inc., 5200 Buffington Road, Atlanta, GA 30349 ("CFA"). The Promotion is governed by these official rules (“Official Rules”). Each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Promotion, as determined by CFA and its agents, are final in all respects. The Promotion is subject to all federal, state and local laws and regulations and is void where prohibited by law.

ELIGIBILITY.  The Promotion is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older at the time of entry who have Internet access and a valid e-mail account prior to the beginning of the Promotion Period. Employees, officers and directors of CFA, McCann-Erickson USA, Inc., Homestay.com, and their respective parents, subsidiaries, agents and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible. CFA has the right to verify eligibility.

PROMOTION PERIOD.  The Promotion begins at 5:00 PM ET on May 17, 2017, and ends at 4:59 p.m. ET on May 19, 2017 (“Promotion Period”).

HOW TO ENTER.  To enter, visit the CFA listing on Homestay.com at https://www.homestay.com/united-states/jasper/143060-homestay-in-ga-jasper?utm_source=cfa&utm_medium=referrer&utm_content=cfa-fb-inc-17 (the “Promotion Website”) during the Promotion Period and submit both (1) a reservation form for the desired dates of the stay at the Cowz Bed and Barn from the designated periods and (2) a description of why you should receive a stay at the Cowz Bed and Barn (each a “Submission”). Text portions of a Submission must not exceed the maximum character amount permitted. Limit of one entry per household.

Only online entries will be accepted. No faxed, emailed or mailed entries will be accepted. Receipt of entry will not be acknowledged, and proof of submission of an entry will not be deemed proof of receipt.

Entry restrictions:  All Submissions must be in keeping with CFA image and may not be offensive, as determined by CFA, in its sole and absolute discretion. Once you upload your Submission, CFA (or its designees) will have the right, but no obligation, to review the Submission for compliance with these Official Rules, and CFA may disqualify any Submission for any reason as determined by CFA, in its sole and absolute discretion.

All Submissions, in whole or in part, become the exclusive property of CFA and will not be returned. By entering this Promotion, each entrant agrees to assign to CFA all right, title and interest that entrant may have in and to his/her Submission. CFA has the perpetual, worldwide, royalty-free, irrevocable, fully-transferable right to use, reproduce, publish, edit, sublicense, and otherwise exploit the Submission in any way, including for promotional purposes in any media or manner worldwide or to otherwise use or commercially exploit any information or ideas contained within any Submission. CFA shall have no obligation to maintain any of the Submissions or information or ideas contained therein as confidential or proprietary. Entrants agree that there is no guarantee that CFA will make use of any Submission.

Additional Entry Conditions:  All components of a Submission must have been created solely by the entrant and be that entrant’s own original creation. Submissions may not have been published previously, in whole or in part, or have been entered into any other promotion. Modifying, enhancing, or altering a third party's preexisting work does not qualify as an original creation. Any Submission that contains offensive language, violates anyone’s privacy, is not in keeping with CFA’s image and the appropriate theme of the Promotion, or does not comply with any aspect of these official rules may be disqualified. The entrant submitting the Submission represents and warrants that (i) the entry information he/she submitted is true and accurate and that the Submission complies with these Official Rules; and (ii) that his/her right to submit the Submission is not restricted in any way.

CFA has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. CFA is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. Proof of submission of an entry will not be deemed proof of receipt. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account” holder is the natural person assigned the email account by the email service providers. Potential winners may be required to show proof of being the authorized account holder.

SELECTION OF COWZ BED AND BARN GUESTS

There were be a total of three (3), two-night scheduled visitations at the Cowz Bed and Barn, to be held on the dates listed at the Promotion Website. Each entrant selected will be permitted to bring a group of up to a total of six (6) guests (the Entrant plus an additional 5 Guests) to each visitation to the Cowz Bed and Barn (“Barn Guests”) based on the desired dates of the stay provided by the entrant. There will be up to eighteen (18) guests for the Promotion. Guests must be 18 years of age or older, except that an entrant selected as a Barn Guest may bring a guest under 18 if the entrant is his or her parent or legal guardian.

Each entry and Submission will be evaluated and judged by a panel of judges made up of representatives from CFA and its agency and their vendors. The panel of judges will select the potential Barn Guests based on the following judging criteria: seventy percent (70%) based on creativity of Submission and thirty percent (30%) based on the expressed love of the CFA Cowz. Love of the CFA Cowz may further be determined by entrant’s social media activity. CFA and its agency reserve the right to include review of an entrant’s related social media activity within the judging of each Submission.

The entrants selected to be potential Barn Guests will be announced on or about May 22, 2017. The selected entrants will be notified by email according to contact information provided by that entrant. Each entrant is responsible for monitoring his/her email account for notification or other communications related to this Promotion. If an entrant cannot be reached by CFA (or its designee) within twenty-four (24) hours or if notification is returned as undeliverable, that entrant will be disqualified and an alternative entrant may be selected as the Barn Guest from the remaining Submissions according to the judging criteria, time permitting. Barn Guests must comply with these Official Rules in order to verified to visit the Cowz Bed and Barn. Barn Guests must sign and return any required forms, including, without limitation, liability and publicity release forms, and IRS-W9 forms, to CFA. If an entrant fails to comply with these Official Rules or fails to return all of the required forms within the time specified, that entrant may be disqualified, and an alternative entrant may be selected by CFA from the remaining Submissions according to the judging criteria, time permitting. The return of the above-mentioned forms within the allotted time shall be solely the responsibility of the entrant; CFA is not responsible for delays in delivery.

VISIT TO THE COWZ BED AND BARN

Barn Visit includes accommodations at the Cowz Bed and Barn in Jasper, GA (specific location to be identified to Barn Guests upon notification) for up to six (6) guests for two (2) nights and food and beverage during stay (ARV:$2,990 for each group of 6 Barn Guests). Barn Guests must be available to visit on dates selected by CFA. No extensions or exceptions shall apply or be available. Availability is subject to change outside of control of CFA. CFA will not be liable for such changes. Barn Guests will not be entitled to the difference between the approximate retail value and actual value of the Barn Visit. Barn Guests must comply with all terms and policies of the Cowz Bed and Barn during the stay.

BARN VISIT IS LIMITED ONLY TO THE LODGING, FOOD AND BEVERAGE AND ACTIVITIES PROVIDED AT THE COWZ BED AND BARN. BARN GUESTS ARE SOLELY RESPONSIBLE FOR ANY TRANSPORTATION TO AND FROM THE COWZ BED AND BARN AND OTHER RELATED EXPENSES INCURRED IN CONNECTION WITH TRAVEL TO AND ATTENDANCE AT THE COWZ BED AND BARN. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE VISIT TO THE COWZ BED AND BARN ARE SOLELY THE RESPONSIBILITY OF THE BARN GUESTS.

ADDITIONAL LIMITATIONS.  Barn visit is non-transferable. Except as otherwise provided herein, no substitution is permitted. CFA and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Promotion, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any Barn Guests, or the visit to the Cowz Bed and Barn. Any attempt to damage the content or operation of this Promotion is unlawful and subject to possible legal action by CFA. CFA reserves the right to terminate, suspend or amend the Promotion, without notice, and for any reason, including, without limitation, if CFA determines that the Promotion cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond CFA’s control corrupt the administration, security, fairness, integrity or proper operation of the Promotion. In the event any tampering or unauthorized intervention may have occurred, CFA reserves the right to void suspect entries at issue. CFA and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

INDEMNIFICATION AND LIMITATION OF LIABILITY.  BY ENTERING THE PROMOTION, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS HOMESTAY TECHNOLOGIES LTD. (HOMESTAY.COM), CFA AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS AND VENDORS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT'S PARTICIPATION IN THE PROMOTION AND ANY PARTICIPATION AS A BARN GUEST.

CFA AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AGENTS AND VENDORS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE PROMOTION.

PUBLICITY.  Each Barn Guest grants CFA and its advertising and promotional agencies and providers and those acting under their permission the irrevocable and perpetual right to use their name, likeness, voice, comments, and any photographs or video or audio footage that may be taken for advertising and publicity purposes in any form of media, now known or hereafter developed or perfected, without payment of additional consideration or acknowledgement, except where prohibited by law.

PRIVACY.  Except as otherwise provided in these Official Rules, information submitted to CFA will be treated in accordance with the terms of the CFA privacy statement available at https://www.chick-fil-a.com/Legal/Privacy and the Homestay.com privacy statement, available at https://www.homestay.com/privacy. CFA may engage certain third party companies to perform services in connection with the administration of this Promotion and information provided by entrants may be collected and used by those third parties for purposes of administration

INTELLECTUAL PROPERTY.  These Official Rules and all related web pages, content and code are the property of the CFA or authorized third parties. The copying or unauthorized use of any of those materials, associated trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
